Regulation (EU) No. 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (hereinafter , the “RGPD”) establishes the legal framework applicable to the processing of personal data.

Access and navigation on the Website, whose domain is https://aguaribay-bcn.com/ (hereinafter, the “Website”), or the use of its services, involve data processing personal information of natural persons by the company Llavor SCP (hereinafter, “Llavor SCP”) in accordance with the RGPD.

These natural persons will be referred to hereinafter as “Users”.

This privacy policy provides information regarding the processing of personal data of Website Users, following the provisions of the General Data Protection Regulation.

Thus, this privacy policy is intended to satisfy the obligation of Llavor SCP to provide information to Users about their personal data, as well as to inform them of their rights and obligations in relation to the processing of said data.

  1. Purposes of the processing of personal data

Llavor SCP will process the data of the Users and of the people who contact the Aguaribay restaurant for the following specific purposes:

  • Use the Website and manage the contracting of services that is carried out through the Website;
  • Manage customer and User reservations;
  • Send electronic communications by email or by SMS to Users about events, news and news of the Aguaribay restaurant, belonging to Llavor SCP;
  • Send commercial and/or promotional information related to the services that Llavor SCP offers and of added value for Users, unless otherwise indicated or the User opposes or revokes their consent;
  • Analyze how to improve the services it provides to Users, as well as to develop and improve the characteristics of the service it offers;

In accordance with the aforementioned purposes, Llavor SCP processes the following categories of data:

  • Traffic and location data;
  • electronic communications metadata;
  • Financial or banking data.

The User guarantees that the data provided is true, exact, complete and up-to-date, being responsible for any damage or loss, direct or indirect, that may be caused as a result of the breach of such obligation. In the event that the User provides data from third parties, they state that they have their consent and undertake to transfer the information contained in this clause, exempting Llavor SCP from any liability in this regard. However, Llavor SCP may carry out verifications to verify this fact, adopting the corresponding due diligence measures, in accordance with data protection regulations.

  1. Legal bases of the treatment

The treatment of the data of the Users is carried out in accordance with the following legal bases:

  • Comply with pre-contractual obligations and execute the contractual relationship;
  • Comply with the legitimate interest of Llavor SCP;
  • Comply with legal obligations;
  • Explicit consent for the communication of User data to third parties in order to carry out commercial communications;
  • Explicit consent in order to comply with the User’s service request.
  1. Data recipients

The data may be communicated to all the employees of Llavor SCP, to its commercial partners, technicians, suppliers, or independent third parties, as well as to organizations, authorities and judicial bodies when Llavor SCP is legally obliged or when such communication of data is necessary to comply with legally established obligations, the general terms and conditions or other agreements, as well as to protect the rights or property of Llavor SCP or the User.

  1. Data retention period

Llavor SCP keeps the data only for the time necessary to carry out the purposes for which they were collected, as long as the Users do not revoke the consents granted. Subsequently, if necessary, it will keep the information blocked during the legally established periods.

Llavor SCP keeps personal data during the execution and maintenance of the commercial relationship established after the User’s request for services.

After the expiration of the periods established in this policy, the data will be deleted.

  1. Rights of Users regarding their personal data

Users of the Website have the right of access, rectification, deletion, the right to limit processing, the right to data portability and the right to oppose the processing of their data.   1. Right of Users to file a claim with the AEPD

Users are informed of their right to file a claim with a supervisory authority, namely, in Spain, with the Spanish Agency for Data Protection (hereinafter, the “AEPD”), when the User considers that Llavor SCP has violated the rights that are recognized by the applicable regulations on data protection.

  1. Treatment Managers

Llavor SCP informs Users that it can involve any person in charge of their choice in the processing of their personal data.

In this case, Llavor SCP will ensure that the data processor complies with its obligations in accordance with the RGPD. Llavor SCP undertakes to sign a written agreement with all its treatment managers and imposes the same data protection obligations on those responsible as are imposed on it.

  1. International transfers of personal data

Llavor SCP has no intention of transferring the personal data of Users outside the borders of the European Union.

  1. Personal data breach

In the event of a security breach of Users’ personal data, Llavor SCP undertakes to notify the Spanish Data Protection Agency under the conditions imposed by the RGPD.

  1. Modifications

This privacy policy may be modified or amended at any time, particularly in the event of legal or jurisprudential developments, decisions and recommendations of the AEPD or changes in use.
